NEW FEDERALLY REQUIRED 2017-2022 RFA ASSURANCES The revised WIOA State Plan Information Collection Requests (ICR) of January 24, 2018 requires Title II state agencies to collect the following new assurances from all providers prior to July 1, 2018: • General Education Provisions Act (GEPA) statement (section 427 of the General Education Provisions Act) • Buy American Assurance (section 502 of the Workforce Innovation and Opportunity Act [WIOA]) 2

  3. SUPPLEMENTAL ASSURANCE DOCUMENT RELEASED APRIL 30, 2018 & DUE MAY 25, 2018. 11:59 PM All of the assurances must be completed, regardless of which program you applied for. No Y q q Our organization will establish and submit (enter statement in row below) a General Education Provisions Act (GEPA) Section 427 statement which provides a description of the steps the applicant will take to ensure equitable access to, and participation in, its Federally-assisted AFELA program. GEPA Statement: q q Our organization will comply with the WIOA Section 502 Workforce Innovation and Opportunity Act of 2014 Buy American Act (BAA) Assurance as follows: (a) COMPLIANCE WITH BUY AMERICAN ACT. — None of the funds made available under title II may be expended by an entity unless the entity agrees that in expending the funds the entity will comply with sections 8301 through 8303 of title 41, United States Code (commonly known as th e “Buy American Act”). (b) SENSE OF CONGRESS; REQUIREMENT REGARDING NOTICE. — (1) PURCHASE OF AMERICAN-MADE EQUIPMENT AND PRODUCTS. — In the case of any equipment or product that may be authorized to be purchased with financial assistance provided using funds made available under title II it is the sense of Congress that entities receiving the assistance should, in expending the assistance, purchase only American-made equipment and products. (2) NOTICE TO RECIPIENTS OF ASSISTANCE. — In providing financial assistance using funds made available under title II, the head of each Federal agency shall provide to each recipient of the assistance a notice describing the statement made in paragraph (1) by Congress. (c) PROHIBITION OF CONTRACTS WITH PERSONS FALSELY LABELING PRODUCTS AS MADE IN AMERICA 3

GEPA STATEMENT GUIDANCE For the GEPA A stat atem ement nt: • Check the “Y” box on the Supplemental Assurance document • Insert your program’s GEPA Statement  The “gepa427.doc” provides the requirements and guidance on the creation of GEPA statements  Check with your agency as most agencies already have GEPA statements in place that can be used or act as a guide in the creation of your program’s statement. 4

BEDA SYSTEM GEPA STATEMENT • Washington’s SBCTC Office of Adult Education ensures equal opportunities to participate for all eligible students, teachers, and other program beneficiaries in any project or activity carried out under the applicable program, such as adult basic education, and promotes the ability of such students, teachers, and beneficiaries to meet high standards. • The office also ensures equitable access to, and participation in, all projects and activities conducted with federal adult education funds. Programs addresses the special needs of students, teachers and other program beneficiaries to overcome barriers to programming and participation, including those based on gender, race, color, national origin, disability, and age. • The office ensures that local providers give equal access to, and equitable participation in, all such projects and activities through the monitoring and technical assistance process and follow the laws required of the Equal Opportunity Hiring Act and the Americans with Disabilities Act. 5
