Safety and Security (S&S)

In a no deal scenario, the UK will phase in the requirement for entry summary declarations (ENS) on all goods arriving from the EU over 6 months. We are taking this approach to give carriers and hauliers more time to prepare for their obligations. The legal requirement to submit an ENS for goods arriving from the EU will come into force in Autumn 2019. In the transitional period, HMRC will work with businesses to get them ready. S&S information required on export will continue to be provided as part of the export customs declaration. We expect that the EU will require an ENS for UK to EU imports and EU to UK exports.

TSP declaration process

The trader submits a simplified frontier declaration before arrival at the border, and ensures all necessary certificates and licences are available: – The reference number for this declaration is given to the haulier as proof customs formalities have been entered into. – On arrival in the UK, the trader updates the declaration to arrived before the end of the working day following the crossing. – This is followed by a supplementary declaration by the 4th working day of the month following the arrival of the goods in the UK. – If the trader is already using this process for some goods, they can choose to use it for standard goods as well. TSP Standard Goods process (EIDR): – The trader makes a declaration directly to their commercial records when the goods cross the border. – The trader will provide the haulier with their EORI number as proof the goods are subject to a TSP process. – This is followed by a supplementary declaration by the 4th working day of the month following the arrival of the goods in the UK.

Guarantees

C U S T O M S

Financial guarantees are required to cover Customs, VAT and Excise duties where they are not paid straight away. In the event of a No Deal temporary easements will apply for customs guarantees (no change to guarantees for Excise). Duty deferment: ‒ Guarantees are required in order to defer duty to make monthly payments, but direct debit details can be provided without a customs comprehensive guarantee (CCG) authorisation. ‒ Traders will have until 30 June 2019 to submit guarantees to HMRC. ‒ Traders can still seek a CCG authorisation if they have AEO C status and would like to apply for their financial guarantee for duty deferment to be reduced. Special procedures: ‒ Most traders will not require guarantees where duties are suspended and may not become due. ‒ Traders will be given at least 12 months’ notice before guarantees are reintroduced. ‒ Some high-risk traders may still be asked to provide guarantees. ‒ No change to transit or to be an authorised consignor.

CHIEF & the Customs Declaration Service (CDS)

HMRC has put contingency plans in place to ensure that its systems will have sufficient capacity to handle increased volumes of customs declarations for trade with EU countries and to implement required D1ND changes on CHIEF and CDS. HMRC Contingency Planning for EU Exit impact on: – Customs declaration types – Customs Procedure Codes (CPCs) – Tariff rules – Mandatory, conditional or optional data requirements and other validation rules Actions being taken: – CHIEF and CDS will operate in tandem for import declarations (this is known as “dual running”). – CHIEF is being scaled up from being capable of handling 100 million declarations a year to 300 million. – CDS has been built to handle anticipated post EU exit declaration volumes. – Changes to current customs declaration procedures for D1ND are being publicised on GOV.UK . – Customs Information Papers, Tariff Volume 3 updates, and technical documentation will detail specific rule changes and impacts due to either CHIEF or CDS.

RoW rules will apply to imports of excise goods from the EU What this means

  • UK businesses will need to make an import declaration and:

– account for the excise duty at the border; or – enter to the goods to the excise warehousing regime via EMCS (Excise Movement Control System)

  • UK businesses can use Customs procedures for EU goods, e.g. Customs

Warehousing, Transit etc. This will increase the volumes of goods at risk under customs control

  • Businesses can continue to use EMCS to move goods in duty suspense in the UK

from the port to a registered warehouse

  • The Registered Excise Dealers and Shippers system (REDs) will be obsolete and

To export live animals or animal products, fish, shellfish, crustaceans and fishery products from the UK to the EU in a no deal scenario, exporters will need to apply for export health certificates (EHCs). Animals, animal products, fish, shellfish, crustaceans or fishery products will need to enter the EU via an EU BIP. EHCs will need to be signed by either an official vet or, for fish and fish products, an official inspector Exporters need to make sure that their EU-based import agent has pre-notified the EU BIP that their consignment is going to arrive. To start the EHC application process, exporters can either use the new EHC form finder at gov.uk or contact their local authority.

Check what documents and/or certificates (e.g. Phytosanitary Certificate) are required for the goods you import across the UK-EU border and apply for them Goods coming from a 3rd country via the EU and entering via a RoRo port will be directed to be checked inland at a ‘Place of First Arrival’ (PoFA), or the goods will be diverted to a non-RoRo port where border checks can be carried out. The importer will Pre-notify the UK authorities about the goods you import across the UK-EU border using the PEACH system (for goods entering in England and Wales).
