  6. Evaluation criteria Step 2. Prequalification criteria • Only tenderers that are B-BBEE Level 1-2 can tender. Mandatory Requirements for Pre-Qualification • Certified copy of B-BBEE Certificate issued by a SANAS Accredited Verification Agent; or • Certified copy of B-BBEE Sworn Affidavit for either EME or QSE.; or • Copy of B-BBEE Certificate issued by CIPC for EMEs’ only. 6

  7. Mandatory Requirements Step 3. Mandatory tender returnables required for evaluations are listed hereunder: • Proof of ownership / Sworn Affidavit between owner and leasing party / signed letter of intent to lease from a traceable leasing party must be submitted, for the required 400 portable chemical toilets. (The Employer may visit the tenderer’s site for an inspection as confirmation of the units) • Proof of ownership (registration certificate) / Sworn Affidavit between owner and leasing party / signed letter of intent to lease from a traceable leasing party must be submitted, for the following honey suckers. Mandatory Requirements continues….. a) 4 x10 000L (or bigger) Tankers b) 5 X 8000L Tankers • Valid Licence for Hazardous Waste Transportation • Sewer Waste Disposal Permit A tenderer that does not submit mandatory documents/information in required in mandatory documents by the required deadlines as stipulated in the Tender Returnable section of the respective Invitation to Tender; will be deemed non-responsive. 8

  9. Evaluation criteria Step 4 – Functionality A weighted score-card approach is used to evaluate the functionality compliance of the tenders against the specifications. Tenders need to have a weighted score of 70% or more for functionality to qualify for further evaluation. The functionality weighting will include technical, safety, health and environment (SHE) and quality. Technical Functionality Maximum number of points Tenderers will be expected to Criteria percentage score at least the minimum threshold per functional area to proceed to the next phase Technical 100% 70% Tenderers will be expected to score an overall minimum threshold of 70% or more on functionality to qualify for further evaluation . Evaluation criteria Step 5 – Price and Preference Price Evaluation (80 points) Adjudication Criteria Points Price Evaluation 80 Ps = 80 (1 – Pt – Pmin ) Pmin Where: Ps = Points scored for price of tender under consideration Pt = Rand value of tender under consideration Pmin = Rand value of lowest acceptable tender B-BBEE status will be scored out of 20 points in accordance with PPPFA. If a tenderer fails to submit proof of B-BBEE status level the tender will not be disqualified, but tenderer: • May only score points out of 80 for price ; and • Scores 0 points out of 20 for B-BBEE 10

Commercial evaluation � Commercial evaluation criteria do not carry a weighting in the tender evaluation however it evaluates compliance to the following: � Submission of tender returnables (Check for completeness) and an assessment by Eskom that it is satisfied that the tender meets the criteria for responsiveness. Acceptance of Term Services Contract (NEC3) (Assess deviation risks - qualifications must be acceptable to Eskom). � Any statutory requirement not adequately provided for at tender stage must be adhered to prior to contract award e.g. valid South African Revenue Services (SARS) certificate. 11
