Presentation of the draft Lambeth Anti Social Item 3 Behaviour (ASB) Strategy (All Wards/All Areas) Executive portfolio: Community Safety, Regeneration & Transport Authorised for submission by: Director of Community Renewal 573/03-04 Linden Rowley 10 th May 2004 The Executive Executive Summary The purpose of the report is as follows: • To present the draft for endorsement and to outline the financial implications for the council in terms of delivery Recommendations (1) That the Draft Lambeth Anti Social Behaviour (ASB) Strategy be endorsed. Funding The Lambeth Community Safety Partnership (DAAT/CDRP) receives no specific funding from central government to support the delivery of the Anti Social Behaviour Strategy. There is an expectation from central government that effective delivery of the strategy would be seen as part of the “mainstreaming” of community safety (Section 17 of the Crime and Disorder Act). Although growth is not sought in kind, commitment from Directorates will be required. There has been specific government funding for the carrying out of an ASB audit. It has already been indicated that a small funding grant will be made available in 2004/5 towards addressing anti social behaviour. The amount is anticipated to be in the region of £30,000. Context 1.1 The Anti Social Behaviour Act 2003 comes into force in March 2004. This legislation increases the powers available to the Police, local authorities and housing providers to address anti social behaviour. The Act also includes a range of orders and support mechanisms around young people and parents, which need to be considered. 1.2 The Government launched its “Together” tackling anti social behaviour action plan on 14th October 2003 (copy attached). The plan highlights the increased scrutiny on the Crime And Disorder Reduction Partnership’s, Councils and Police in how they tackle Anti Social Behaviour in the National Policing Plan. 1.3 The Community Safety Partnership is responsible for the development and delivery of an Anti Social Behaviour Strategy. Each partner organisation has been consulted and will be asked to endorse the strategy. 1.4 The Community Safety Strategy incorporated Tackling ASB as one of its 13 targets in the 2002-05. 3 Presentation of the draft Lambeth Anti Social Behaviour (ASB) Strategy

  4. 1.5 In preparation for the development of the ASB Strategy the partnership has established an ASB Strategic Steering Group, which will ensure effective delivery of the strategy. 2 Financial implications There is a clear extension of powers given to Local Authorities to deal with ASB. To employ these powers may require additional resources, predominantly officer time (as per paragraph 2.3). Additionally, there is potential for the Case Review Teams to encourage efficiencies in terms of sharing of information and a reduced level of duplication (as per paragraph 2.4). However, to maintain the Council's overall revenue budget at the level set by full Council on the 25th February 2004, any additional resource requirement will need to be met, by each responsible department, from within existing budgets. 2.1 Background:- Anti Social behaviour is a key part of central governments agenda for community safety. Objectives in relation to Anti Social behaviour have now been incorporated into the Policing Plan. The Community Safety Partnership will be scrutinised by the Home Office on a monthly basis in relation to performance. This increased scrutiny from the Home Office Anti Social Behaviour Unit and the new powers may result in financial pressures on existing services. The following grid reference gives an indication of the key powers, which relate to each service area, however a fuller explanation is incorporated in the attached strategy. 2.2 Grid Reference Service Area Powers under the 2003 Comments Act • Closure of premises • 3-6month closure of Housing where drugs are any premises used unlawfully used for the supply of class A drugs • Injunctions • against any person whose behaviour • Security of tenure could cause a nuisance or on grounds of breach • Proceeding for Possessions • Demotion order for behaviour is capable 4 Presentation of the draft Lambeth Anti Social Behaviour (ASB) Strategy

  5. of causing nuisance or annoyance • Applications for ASBO’s • BTP, local authorities and registered social landlords can apply for ASBO’s . Applications can be made through county courts and in the Crown Court • Parenting orders • Counselling Education programmes for parents can be residential and take place more than once a week • Parenting Contracts • Voluntarily signed contracts between schools LEA’s and parents • Penalty Notices for truancy • Fixed Penalty notice against parents whose child fails to attend school regularly • Curfew orders and Supervision orders • Supervision orders for offenders under 18 to be extended Penalty Notices extended to include 16 and 17 year olds • Penalty Notices for Disorderly behaviour 5 Presentation of the draft Lambeth Anti Social Behaviour (ASB) Strategy
