EXTERIOR SOUND LIMITS

  • Construction normally occurs 7am – 10pm (Mon-Fri)

and 9am – 10pm (Weekends & Legal Holidays)

  • In general, the Seattle Noise Ordinance allows noise

to exceed sound limits by 25 decibels (averaged) during normal construction hours

  • After 10pm, those exceedances go away
  • This project has requested relief from noise limits

described in the noise ordinance and WSDOT will be presenting their project tonight

GRANTING A NOISE VARIANCE – PART 1

  • SDCI Noise Abatement group may grant variances

necessary for nighttime construction activities such as:

  • Allowing tower cranes and oversized equipment that

have limited access during normal working hours

  • Utility work that requires shutting off essential services

to a business and/or households

  • Standards for granting a noise variance state

(SMC 25.08.590):

  • The noise occurring or proposed to occur does not

endanger public health or safety

  • The applicant demonstrates that the criteria required for

the variance are met

GRANTING A NOISE VARIANCE – PART 2

  • In reviewing all variance applications, the Noise

Abatement Group reviews the information provided that justifies the need for a variance:

  • Whether the applicant’s information and analysis is

accurate and complete

  • The type of sound levels proposed by the variance
  • The proposed times and duration of the sound
  • The topography and population density of the area
  • Whether the public health and safety is endangered
  • Whether proposed noise mitigation measures are

likely to be effective

CRITERIA FOR APPROVAL

  • The City may grant a Major Public Project Construction

Noise Variance (MPPCNV) to provide relief from the exterior sound limits only to the extent the applicant demonstrates that compliance with the levels would:

  • Be unreasonable in light of public/worker safety or cause

the applicant to violate other applicable regulations, including but not limited to regulations that reduce impacts on the transportation infrastructure or natural resources; or

  • Render the project economically or functionally

unreasonable due to factors such as financial cost of complying for the duration of the major public project

extended to accept comments through August 2nd, 2019

  • The decision will be published in The

Seattle Times and our Land Use Information Bulletin

  • The appeal period takes place during

the first 10-days of the waiting period

Why is nighttime work necessary?

  • SR 520/I-5 Project construction during nighttime hours is necessary in order to:

– Provide a safe work environment for the contractor and traveling public – Avoid adding to existing congestion on SR 520 and I-5 – Minimize impacts to the community and cost to taxpayers caused by extended project duration and significant daytime traffic impacts When would the variance be applicable?

  • During nighttime construction hours of the SR 520/I-5 Project, defined as 10 p.m. to 7

a.m. on weekdays, and 10 p.m. to 9 a.m. on weekends and legal holidays

  • The I-5 express lanes are closed nightly which allows for construction activities to
