Recent ¡Court ¡Rulings… Ÿ March ¡2015 ¡– ¡Joe ¡v. ¡McBay: ¡City ¡Drone ¡v. ¡Country ¡ Shotgun Ÿ Joe ¡built ¡a ¡UAS ¡equipped ¡with ¡a ¡camera ¡to ¡monitor ¡ his ¡walnut ¡orchard ¡in ¡Modesto, ¡CA. ¡ ¡ Ÿ While ¡tes9ng ¡it, ¡his ¡neighbor, ¡McBay, ¡thought ¡it ¡was ¡ a ¡CIA ¡surveillance ¡device ¡so ¡he ¡had ¡his ¡son ¡blast ¡it ¡ out ¡of ¡the ¡sky. Ÿ Joe ¡asked ¡for ¡reimbursement ¡and ¡McBay ¡refused. ¡ ¡ Joe ¡filed ¡suit ¡in ¡small ¡claims ¡court ¡and ¡was ¡awarded ¡ $850. Recent ¡Court ¡Rulings… Ÿ March ¡2014 ¡– ¡an ¡Administra9ve ¡judge ¡ruled ¡in ¡favor ¡ of ¡Ralph ¡Pirker ¡who ¡was ¡fined ¡$10k ¡for ¡opera9ng ¡a ¡ UAS ¡at ¡the ¡Univ. ¡of ¡Virginia. Ÿ Judge’s ¡decision ¡cited ¡the ¡FAA‘s ¡failure ¡to ¡adhere ¡to ¡ proper ¡procedures ¡in ¡banning ¡UAS ¡use. Ÿ The ¡FAA ¡appealed ¡and ¡won. ¡ ¡Ul9mately, ¡Pirker ¡agreed ¡ to ¡pay ¡$1,100. ¡ ¡Importantly, ¡though, ¡the ¡FAA ¡ commenced ¡the ¡proper ¡procedures ¡as ¡a ¡result ¡of ¡the ¡ ALJ’s ¡decision.
