Clean Energy Act of 2018 Signed May 23, 2018 • Amended RPS and Net Metering Rules in NJ • Increased Class I Requirements; 21% by 1/1/20 , 35% by 1/1/25, 50% by 1/1/30 • Class I RPS Costs Capped at 9% of EY19, EY20, EY21 Electricity Sales & 7% thereafter (subsequently amended to average costs from EY19 to EY24) • Accelerated RPS Compliance Schedule for Solar in EY 19 - EY 21; 4.3%, 4.9%, 5.1% • Exempts BGS Provider Existing Supply Contracts (Prior to 05/23/18) from new Solar Requirements – 100% in EY 19, 66% in EY 20, and 33% in EY 21 are exempt • “This limited exemption for providers existing supply contracts shall not be construed to lower the State wide solar requirement … “ (CEA 2018) • Requires distribution of the incremental solar obligation that is not met because of the exemption among the non-exempt electricity supplied by BGS Providers • Revised and Reduced SACP Schedule – EY 20 extended to EY 33. RPS/BGS Rule Adoption Sept. 16, 2019 o Increased the Class I RPS obligation to 50% by 2030 (Table A); o Increased the solar RPS for the next three EY while exempting contracted BGS supply from contributing to the increased solar obligations; o Allocates the avoided increase from the exemption in a competitively neutral manner; o Sets a Class I RPS cost cap that is equal to nine percent of total retail sales in EY19, EY20, and EY21 and seven percent in any EY thereafter; o Removed the provision that TPS/BGS Providers can submit Class I RECs to satisfy their Class II RPS Requirements; and o Makes the Solar Requirement a carve-out within the Total Class I Requirement Beginning in EY20 (non-exempt supply).
