  2. WHY UPDATE D&C NOW? st nd rd 1 2 3 Permit Issuance Anniversary Anniversary Anniversary Time April 2017 April 2018 April 2019 April 22 , 2016 Implement Permit 1,000 SF LIDA HydromodificaAon Treatment Requirement PrioriAzaAon Plan Threshold Phase 1 Phase 2

  3. What topics are included in Phase 1 Draft Standards? Stormwater Sanitary • 1,000 SF treatment threshold • Sanitary Conveyance from Private System • LIDA incentives • Storm Connections to Sanitary (example: trash enclosures, wash pads) • Redevelopment Table 4-1 • Storm Master Planning • Procedural (Housekeeping) • Turf fields with underdrains • Update 1200C/CN language • Planting requirements for WQ • Maintenance Plans Facilities • 2-Year Maintenance Period for Filter Vaults • LIDA Lot Submittal Requirements Erosion Control • Approved Product List • Erosion Control Permit Threshold • Model Homes • BMPs for stream/wetland restoration projects • Update Standard Details • Typo and Reference Corrections Ch. 1 Ch. 4 Ch. 2 Ch. 6 • Definitions Related to Updated Topics

  4. What topics are included in Phase 1 Draft Standards? • Chapter 1 Definitions • Chapter 6 Erosion Prevention & Sediment Control § Add & clarify existing definitions § Require supplemental plans to address: • Chapter 2 Administrative Procedures v Runoff control during wet weather § Erosion control permit threshold v Dewatering § 1200-CN references v Concrete treatment of soils § Clarify maintenance requirements § Reference to stream and wetland § Submittal requirements for Model restoration BMPs Homes, “LIDA lots,” construction on § Reference to 1200-CN single family residential lots § Protocol for use of chitosan • Chapter 4 Runoff Treatment & Control § 1,000 SF treatment threshold • Appendix B Standard Details § LIDA prioritization § Update & standardize formatting § Redevelopment § Minor content changes

  8. Standard Details

  9. CHAPTER 4: RUNOFF TREATMENT AND CONTROL • 3 Key Topics § 1,000 SF treatment threshold § LIDA/GI prioritization § Redevelopment

  10. Stakeholder Input Addressed in Initial Chapter 4 Draft • General § Desire for clear and objective Standards § Create a “decision tree” or sizing tool § Consider impact to buildable area (LIDA) § Consider physical and fiscal constraints § Continue to allow option to “trade” treatment area § Consider exemptions for certain activities ( ADA upgrades, other?) • Redevelopment § Ratio options are preferable for simplicity § Incentivize net reduction in impervious area (no penalty for removing impervious) § Resolve treatment issues for small projects on large sites. § Resolve confusion when a project is reviewed as ‘development’ or ‘redevelopment’

  11. Initial DRAFT of Chapter 4: Runoff Treatment and Control. Interim draft; contains conceptual language addressing the following: § Treatment requirement for all development creating or modifying 1,000 SF or more of impervious area, including single family construction and partitions. § Language to address the new permit requirement to prioritize Green Infrastructure and Low Impact Development Approaches (LIDA). § Methodology to calculate treatment requirements that consolidates development and redevelopment into a single section. § General housekeeping changes, including changing the term "facility" to "approach" for water quality treatment types.

  12. Initial DRAFT of Chapter 4: Runoff Treatment and Control. The Initial Chapter 4 draft also included: § An analysis of the Table 4-1 alternatives § New water quality treatment calculator (Figure 4-1).

  13. New Language LIDA • All development required some LIDA or GI • List documenting approved approaches • CWS has been requiring some form of LIDA for years including Swales, buffer strips and riparian restoration • Evaluated during site planning • Reality important aspect – thresholds – have not been defined for all of treatments e.g. 1 tree and canopy cover has not been defined (1 tree, areal coverage, ?)

  14. LIDA & Green Infrastructure Prioritization Concept • Treatment Approaches • Green Infrastructure § Vegetated Swale § Upland Tree Preservation § Extended Dry Basin § Vegetated Corridor Preservation § Constructed Water Quality Wetland § Minimize impervious area: green roofs, green walls, porous pavement, boardwalks § Structural Infiltration Planter § Rainwater catchment and harvesting § Flow-Through Planter systems for re-use § LIDA Swale § Parking minimization: compact parking § Street-Side Planter spaces, shared parking (on-street, shared § Landscape Filter Strip lots, public lots), underground or stacked § Non-structural infiltration planter parking § Vegetated Corridor as a Filter Strip § Lawn conversions to native landscaping § Proprietary Treatment Systems § LIDA for water quality treatment

  15. WHATS NEXT? • January § Distribute Chapters 1, 2, 6 and details to the public § Review public comments § Jan. 26 th Stakeholder Meeting • February § Feb. 8 th CWAC meeting § Prepare full draft of proposed Standards § Legal review • March § Public Notice § Board Hearing

  21. HOW TO STAY INVOLVED IN THE PROCESS • Check out the D&C Update Webpage cleanwaterservices.org/dncupdate • Get on the Email List (link on webpage) • Submit comments or questions DnCupdate@cleanwaterservices.org

  22. INPUT ON KEY TOPIC DRAFT UPDATES • 1,000 SF treatment threshold § Exempt ADA projects (such as sidewalk ramp retrofits) by defining them as maintenance. § The changes to the on-site treatment criteria used to determine fee-in-lieu eligibility are too broad. § Revise fee-in-lieu amount for small sites on the cost of a more typical LIDA – such as flow-through planter. § Add a provision to the on-site treatment criteria that allows for treating adjacent or nearby equivalent amount v Currently specified in 4.05.4 (a)

  23. INPUT ON KEY TOPIC DRAFT UPDATES • LIDA/GI prioritization § Modify thresholds so that they are above and beyond land use code requirements. v Intent of updates is to incorporate green infrastructure options currently available through land use code requirements. § Concern that land use codes may not have sufficient provisions for these approaches, or may contradict these approaches and that a fee-in-lieu should be available. § Quantify performance criteria for the GI approaches

  24. INPUT ON KEY TOPIC DRAFT UPDATES • Redevelopment § Equivalent level of support for the ‘modified’ and ‘simplified’ approaches § In calculator, state at top that treatment is not requirement for projects that only remove impervious area.
