  • Grants the New York state board on electric generation siting and

the environment exclusive authority to approve the construction of new electric generating plants, including wind farms.

  • Creates a forum for the comprehensive examination of a proposed

generating facility’s public purpose; potential impacts, both positive and negative; and provisions for avoiding, minimizing and mitigating any negative impacts.

  • Replaces local municipal approvals that would normally be required.

  • The board on electric generating siting and the environment (the “Siting

Board”) is composed of heads of the following state agencies:

  • Department of Public Service (DPS)
  • Energy Research and Development Authority (NYSERDA)
  • Department of Environmental Conservation (DEC)
  • Department of Health
  • Empire State Development
  • Plus two “ad hoc” members who reside in the municipality
  • The Siting Board is staffed by experts from the DPS and DEC

The Siting Board may approve a proposed new facility only after: (1) Identifying the facility’s impacts on:

– the natural environment; – public health and safety; – recreational, historic and cultural resources; and – transportation and other infrastructure, and

(2) Finding that the facility:

– is a beneficial addition to the state’s electric generating grid, – will be in the public interest, – has been designed to minimize any adverse environmental impacts, – will operate in compliance with state and local laws
