What is Article 10? • Grants the New York state board on electric generation siting and the environment exclusive authority to approve the construction of new electric generating plants, including wind farms. • Creates a forum for the comprehensive examination of a proposed generating facility’s public purpose; potential impacts, both positive and negative; and provisions for avoiding, minimizing and mitigating any negative impacts. • Replaces local municipal approvals that would normally be required. What is the Siting Board? • The board on electric generating siting and the environment (the “Siting Board”) is composed of heads of the following state agencies: • Department of Public Service (DPS) • Energy Research and Development Authority (NYSERDA) • Department of Environmental Conservation (DEC) • Department of Health • Empire State Development • Plus two “ad hoc” members who reside in the municipality • The Siting Board is staffed by experts from the DPS and DEC October 2015 12

Siting Board Approval Criteria The Siting Board may approve a proposed new facility only after: (1) Identifying the facility’s impacts on: – the natural environment; – public health and safety; – recreational, historic and cultural resources; and – transportation and other infrastructure, and (2) Finding that the facility: – is a beneficial addition to the state’s electric generating grid, – will be in the public interest, – has been designed to minimize any adverse environmental impacts, – will operate in compliance with state and local laws October 2015 13

The Article 10 Process • Planning and public outreach – Applicant identifies stakeholders and their concerns and questions and provides information about the project • Preliminary scoping – Applicant, stakeholders, and agencies reach agreement on studies to be done • Application preparation, filing and public notification – By Applicant • Application completeness review – By Siting Board • Application review – By stakeholders and state and local agencies, – Issue identification, hearing(s) • Decision by Board October 2015 14

Funding for Participants • Bull Run will deposit funds to support participation in the Article 10 process by municipalities and local parties. • When? – At the filing of the preliminary scoping statement – At the filing of the article 10 application • How much? – Preliminary scoping − $105,000 – Application review − $300,000 • Who may apply for funds? – Local municipalities – Local residents and parties representing local residents • What may fund be used for? – Hiring consultants, experts and lawyers to review documents, prepare analyses and participate in hearings • How are funds made available? – Those seeking funds apply to the board’s hearing examiner with detailed plans for how the funds will be used October 2015 15
