DBE Program Overview

  • Our current triennial goal is 5.98% DBE participation for FTA-funded

contracts.

Small Business Classifications

  • Disadvantaged Business Enterprise (DBE) means a Small Business Concern that has

successfully completed the DBE certification process and has been granted DBE status by an AZUCP member pursuant to the criteria contained in 49 CFR Part 26.

  • Small Business Enterprise (SBE) means a small business that has been determined to

meet the requirements for SBE certification with the City of Phoenix and whose certification is in force at the time of the award of business by the City. A directory of currently certified SBE firms is located at https://phoenix.diversitycompliance.com .

  • Small Business Concern (SBC) means, with respect to firms seeking to participate in

contracts funded by the USDOT, a Small Business Concerns as defined in Section 3 of the Small Business Act and Small Business Administration regulations implementing the Act (13 CFR part 121), which Small Business Concern does not exceed the cap on average annual gross receipts specified in 49 CFR § 26.65(b). “Small Business” and “Small Business Concern” are used interchangeably in this DBE Contract Clause.

Requirements: Form EO 1

If selected as the Successful Submitter, the Successful Submitter will:

  • Fulfill all required small business outreach requirements and shall submit all required
  • utreach efforts documentation for contracting opportunities within 30 days or a date

determined by the City following contract award recommendation;

  • Conduct all required small business outreach and will submit all supporting

documentation; and

  • Comply with the Race - and Gender-Neutral post-award requirements stated in the DBE

Contract Clause.

Submitter’s Required Outreach Efforts

Recommended offeror must demonstrate that they performed the following outreach efforts:

Identify DBE and Small Business participation

Solicit proposals from DBEs and small businesses. Evaluate in good faith each DBE and Small-Business proposal.

Communicate selection decisions to all, including each rejection of a DBE

Submitter’s Required Outreach Efforts

  • Successful submitter must demonstrate its outreach efforts (identify, solicit,

evaluate, and communicate) in documentation submitted within 3 days following recommended offeror.

  • Outreach efforts are required as a condition of responsiveness.
  • If the successful Submitter fails to conduct outreach or fails to submit the

required documentation, the Agency will declare the Successful Submitter proposal non-responsible.

  • Nonresponsive bids, statements of qualifications, or proposals will be rejected.

A few words about DBEs . . .

  • To be counted, a firm must be officially certified as a DBE:

  • DBE’s must be certified in the trade for which the bidder plans to utilize the DBE
  • n this contract.
  • A DBE must perform or exercise responsibility for at least 30% of the value of its

contract with its own forces and equipment.

Final Thoughts

  • The successful submitter receiving notice of award recommendation will be

contractually obligated to achieve the participation percentage in EO 3

  • Failure to Submit Form EO–1 completed and signed will deem bidder
  • nonresponsive. A nonresponsive Offer will be disqualified from further evaluation.
  • Successful Submitter will have 3 days to submit the completed EO-2 and EO-3 form

as well as all supporting documentation (i.e. phone logs, emails)

  • Failure to submit documentation will result in a non-responsible determination and

removal of offeror
