HB28 Changes

As of August 28, 2013:

  • Only required for the construction an earthen storage

structure to hold, convey, contain, store or treat domestic, industrial, or agricultural process wastewater.

  • All other construction activities at point sources are

exempt.

  • A facility need only comply with these rules when they

come within the definition of an agrichemical facility.

  • Any existing agrichemical facility that has a discharge of

agrichemicals or process generated wastewater to the environment will be required to take immediate steps to implement the secondary and operational containment requirements contained in this rule.

  • All facilities will be designed to be no-discharge.
