What is ACT211?

  • To enact R.S. 39:1624(A)(10) and R.S. 47:1508(B)(41) and 1678, relative to

tax clearances from the Department of Revenue; to require a tax clearance for the issuance or renewal of a sales tax resale certificate; to require a tax clearance for approval of certain state contracts; to provide for exceptions; to provide for an effective date; and to provide for related matters.

What Does this Mean?

  • Before approving a proposed contract for professional, personal, consulting, or

social services:

  • The prospective contractor must be current in the filing of all applicable tax

returns and reports, and in payment of all taxes, interest, penalties, and fees

  • wed to the state and collected by the Department of Revenue in accordance

with R.S.47:1678.

What is Required?

  • An LDR account number must be provided. Federal Id numbers are not currently

accepted.

  • Sole Proprietorships, LLC’s and Partnerships must provide an LDR account number

for the business, or social security numbers/LDR account numbers for all members to review the individual income tax accounts.

  • All Corporations, LLC’s, Partnerships must be registered with Secretary of State

(SOS).

  • Legal name provided, must match LDR account number provided.
  • All non-profit organizations must be listed on IRS website as a non-profit, or

documentation of proof from IRS must be presented.

  • Each account must be current in filing and no outstanding balances due.

Exempted: Who is?

  • What contractors are exempted from this process?
  • Out of State
  • Out of Country
  • No Employees
  • No Sales Tax
  • Not registered with the Secretary of State (SOS)
  • If the contractor meets the requirements listed above the agency would then

request an R-7101 form that must be completed, notarized and submitted to the Louisiana Department of Revenue.
