Les exceptions à cette règle sont citées aux articles 145 et 147 où des travaux, tels que l’emploi salarié en tant que comédien ou interprète dans les spectacles publics, l’exercice d'acrobaties, de contorsion ou l’exécution de tout autre travail comportant des risques sur la vie, la santé ou la moralité sont interdits aux mineurs de moins de 18 ans. Le législateur a inséré également un article préventif (146) interdisant le lancement de « ...toute publicité abusive incitant les mineurs à s'adonner à la profession d'artiste et à en souligner le caractère lucratif ». Le code aborde en outre, le sujet des conditions de travail des enfants. Il confie à l'agent chargé de l'inspection du travail, le droit de requérir un examen de santé de tous les mineurs salariés âgés de moins de dix-huit ans, de manière à vérifier si le travail dont ils sont chargés n'excède pas leurs capacités. En cas d’excès, l’inspecteur du travail a le droit d'ordonner, sans préavis, le renvoi des mineurs de leur travail. Les articles 149, 150 et 151 ont été consacrés aux sanctions applicables en cas d’infraction d’un des articles cités. La règle générale fixée par l’article 171 est l’interdiction de l’emploi des mineurs de moins de seize ans dans des emplois nocturnes. Les mineurs âgés de dix-sept à dix-huit ans (et donc autorisés au travail de nuit) doivent bénéficier, entre deux journées de travail de nuit, d’un repos dont la durée ne peut être inférieure à onze heures consécutives comprenant obligatoirement la période de travail de nuit. La question des travaux souterrains est abordée lors de l’article 179 interdisant ce type de travaux aux mineurs âgés de moins de dix-huit ans. Les sanctions prévues en cas de violation de cet article sont décrites par l’article 183. Enfin, le code énonce le principe général concernant les travaux dangereux. Il interdit l’emploi des mineurs de moins de 18 ans dans des travaux « susceptibles d'entraver leur croissance ». Les travaux dangereux sont énumérés par l'article premier du Décret n° 2- 04-682 du 29 Décembre 2004 fixant les travaux interdits aux mineurs de mpoins de 18 ans, aux femmes et aux salariés handicappés.
