• Who ¡is ¡a ¡Refugee? ¡ ¡ ¡ ¡ ¡A ¡Refugee ¡is ¡a ¡person ¡who ¡has ¡a ¡well-­‑founded ¡ fear ¡of ¡being ¡persecuted ¡on ¡account ¡of ¡his ¡or ¡ her ¡race, ¡religion, ¡na<onality, ¡poli<cal ¡opinion, ¡ gender ¡or ¡membership ¡of ¡a ¡par<cular ¡social ¡ group; ¡his/her ¡life, ¡physical ¡safety ¡or ¡freedom ¡ would ¡be ¡threatened ¡on ¡account ¡of ¡external ¡ aggression, ¡occupa<on, ¡foreign ¡domina<on ¡or ¡ other ¡events ¡seriously ¡disturbing ¡public ¡order ¡ in ¡either ¡part ¡of ¡the ¡country ¡or ¡the ¡whole ¡of ¡ his ¡or ¡her ¡country ¡of ¡origin. ¡ ¡

Who ¡is ¡an ¡Asylum ¡Seeker? ¡ • An ¡Asylum ¡Seeker ¡is ¡a ¡person ¡who ¡has ¡leE ¡his/ her ¡country ¡of ¡origin/birth ¡to ¡seek ¡refugee ¡in ¡a ¡ foreign ¡country. ¡ ¡ • This ¡person ¡will ¡be ¡granted ¡an ¡asylum ¡ seeker ’ s ¡permit ¡(Sec<on ¡22) ¡while ¡wai<ng ¡for ¡ their ¡refugee ¡status ¡to ¡be ¡confirmed. ¡ ¡ • A ¡Refugee ¡carries ¡a ¡Sec<on ¡24 ¡permit. ¡ Moreso, ¡A ¡Refugee ¡is ¡granted ¡the ¡same ¡rights ¡ as ¡South ¡Africans ¡except ¡the ¡right ¡to ¡vote. ¡ ¡

Refugee ¡Rights ¡ ¡ ¡ • The ¡rights ¡of ¡foreigners ¡are ¡not ¡protected ¡ • Crime ¡Prevention ¡and ¡Control : ¡ Intervention ¡and ¡Responses ¡are ¡not ¡ consistent ¡and ¡sustainable. ¡These ¡ responses ¡show ¡at ¡best ¡a ¡tacit ¡support ¡for ¡ the ¡intention ¡of ¡the ¡perpetrators ¡i.e. ¡In ¡ places ¡where ¡violence ¡erupts, ¡we ¡have ¡ observed ¡that ¡the ¡classic ¡police ¡response ¡is ¡ to ¡lead ¡refugees ¡out ¡of ¡the ¡community. ¡ ¡

Policy ¡Shift ¡in ¡Refugee ¡Protection ¡in ¡South ¡ Africa ¡ • A ¡gradual ¡move ¡for ¡the ¡Securitization ¡of ¡ Migration ¡with ¡the ¡recent ¡proposed ¡closure ¡ of ¡the ¡Refugee ¡Reception ¡Offices ¡in ¡the ¡ country ¡ Implication ¡of ¡the ¡Closure ¡to ¡Refugees ¡and ¡ Asylum ¡Seekers ¡ • Costs ¡implication ¡for ¡the ¡government ¡to ¡move ¡ RROs ¡to ¡the ¡border ¡areas ¡ • Shortcomings ¡in ¡the ¡South ¡African ¡asylum ¡ management ¡system-­‑ ¡Shortage ¡of ¡Staff: ¡Many ¡ officials ¡are ¡unwilling ¡to ¡be ¡relocated ¡to ¡the ¡

• The ¡need ¡to ¡address ¡rela<ons ¡with ¡the ¡local ¡ communi<es ¡in ¡the ¡border ¡areas ¡and ¡the ¡ possibility ¡of ¡scape-­‑goa<ng ¡and ¡xenophobic ¡ abacks. ¡ ¡ • Cost ¡implica<on ¡for ¡the ¡refugees: ¡having ¡to ¡ travel ¡to ¡the ¡border ¡areas ¡to ¡renew ¡permits ¡is ¡ placing ¡significant ¡financial ¡burdens ¡on ¡ refugees, ¡given ¡the ¡fact ¡that ¡they ¡will ¡not ¡all ¡ be ¡served ¡in ¡one ¡day. ¡ • Legisla(on : ¡There ¡is ¡a ¡proposal ¡for ¡foreigners ¡ to ¡be ¡guided ¡by ¡a ¡special ¡bye-­‑law ¡around ¡ opening ¡and ¡opera<ng ¡a ¡business ¡
