  • Sep. 11, 2014: City Council adopted Ordinance M-4090,

prohibiting the establishment or expansion of all crude petroleum facilities for six months.

  • Oct. 20, 2014: Public hearing on moratorium and adoption
  • f findings of fact in support of the moratorium.
  • Council directed staff to prepare a work program to

address concerns associated with the transport, handling and storage of crude oil.

  • Ordinance M-4090 established a moratorium that

precludes new crude oil projects, prohibiting the establishment or expansion of all crude petroleum facilities for six months.

  • Moratorium expires March 11, 2015.
  • Council action required prior to expiration to extend

moratorium and allow for implementation of proposed work program.

Energy Facility Site Evaluation Council (EFSEC) has authority over petroleum facilities that:

  • Can receive more than an average of 50,000 barrels per

day; and

  • Will be or have been transported over marine waters.

(RCW 80.50.20.12.d) Facilities below the thresholds are reviewed by the local jurisdiction.

  • Storage and warehouse facilities are allowed in the IH zone and

in the IL zone as a Limited use

  • Petroleum refineries are allowed in the IH (heavy industrial)
  • zone. (VMC 20.440, Table 20.440.030-1, which further

references Table 20.440.030-2)

  • The current Land Use and Development Code addresses

manufacturing associated with specific materials. However, it does not address shipment or storage of specific materials. These are generally reviewed through the building and fire code reviews.
