Incident Reporting Requirements • Reporting responsibility rests with the party that has firsthand knowledge of the incident • The WSC should submit an incident in the absence of a provider or if not submitted by the provider. • The reporting party is responsible for informing the legal representative (when one exists). • The WSC should confirm the legal representative is aware of the incident and actions surrounding the incident. 8

  9. Incident Definition Activity I was notified that Oliver had an altercation on his school bus this morning on the way to the ADT. He became upset on the bus and was verbally abusive towards the aide and bus driver. Oliver then started to hit the bus driver with his fist and struck the bus driver on his chest and leg. He then proceeded to do the same to the aide. Oliver then attempted to jump off the bus through the back-emergency exit door. The sheriff's office was contacted, and Oliver was arrested and charged with Battery. 1. Is this a Critical or a Reportable incident? 2. What is the specific reporting category? 3.   10. Incident Definition Activity On February 25, Joy went to the hospital for a fever and not feeling well. Joy was informed that she has the flu and pneumonia by the ER doctor. 1.   11. Follow-Up Actions • Any action to mitigate the current situation and actions taken to prevent reoccurrence of a similar incident • Coordinate service changes, if needed or requested • Follow up with the provider or family to ensure the individual is healthy and safe 11

Follow-Up Actions • Document all actions in a follow-up incident report to APD. • Follow-up reports are due within 5 business days of the incident and should be attached on page 2 of the incident reporting form submitted. • When submitting the follow-up report, both the original Incident Report page and page 2 should be submitted. 12

  13. CMS Reporting Requirements • The Centers for Medicare & Medicaid Services (CMS) tracks each state’s incident reporting process and abuse investigation process. • The focus is on timely reporting of incidents, follow-up activities, and taking steps to mitigate future incidents. • Ensuring compliance with reporting and follow-up is a responsibility shared by WSCs, providers, and APD. 13

Case Management Activities • Review any relevant documents before each visit with the person, including Incident Reports. • Understand the individual’s specific risk factors • Significant health and safety concerns should be communicated to the APD Regional Office. • When in doubt, communicate • Always document your conversations and efforts in your case notes 14

Case Management Activities • Ask the person about any potential incidents since your last contact. • Have frequent conversations about abuse, neglect, and exploitation (ANE) and how to report them. • Encourage the person to report instances of abuse against themselves OR if they witness ANE against someone else. 15

  16. Abuse Reporting Requirements • Chapter 39.201 and Chapter 415.1034 Florida Statute • You are a mandatory reporter of suspected abuse • Failure to report is a crime 16
