Current Limits

B. All uses in the C1, C2 and RM zones shall be conducted entirely within a completely enclosed building except that the outdoor storage, display, sale or rental

  • f merchandise or services may be permitted where the standards of subsection D of

this section are met. The following uses and activities, subject to applicable conditions, are exempt from this prohibition: 10. Farmers’ market, subject to subsection (E)(4).

  • E. The following additional requirements are applicable to certain types of outdoor

merchandising:

  • 4. Farmers’ market: The farmers’ market is approved by a site-specific authorization

made by the city manager after finding that the following standards are met: a. The location will not unduly interfere with pedestrian or vehicular traffic; b. The location will not unduly interfere with the operation of adjacent businesses; c. The farmers’ market is conducted for a specified period of time, including hours of operation; and d. The farmers’ market is limited to food, specific food related items and cut flowers.

Oregon Code

  • Class 1 Mobile Units are only permitted to provide prepackaged foods.
  • Class 2 Mobile Units are similar to Class 1, yet they are permitted to serve unpackaged

foods, not requiring assembly or preparation and which have on-board handwashing facilities, with at least 5 gallons of potable water.

  • Class 3 Mobile Units provide insulated containers to transport cooked proteins to the

unit, since raw-to finish cooking of raw proteins is not allowed. All foods under Class 1 and 2 are permitted and the same 5 gallons of potable water for on-board handwashing must be provided.

  • Class 4 Mobile Units allow for a full menu, with the same provisions for potable water

and handwashing as the other classifications.

Sizing

  • Vending Stands are probably the most prohibited or limited form of vending unit across the
  • country. Many communities do not allow these free-standing units at all and if they do,

they are usually limited to events or short durations, such as surrounding Fourth of July or

  • Christmas. Typical examples are fireworks booths and Christmas tree stands.
  • Vending Carts are units that are moveable, most often by a single individual, and are those

units commonly seen operating in city parks, such as the ice cream or hot dog carts. They are usually required to be moveable upon notice and are generally, the most permitted of all units.

  • Mobile Carts or Vending Trucks range in size and shapes, from those pulled by other

vehicles to the common food trucks that now inhabit most major American cities. ○ Utility Trailers are units that are towed into place by another vehicle, but often operate as temporary stand-alone units. These units often become semi-permanent fixtures in some areas and in others are required to be moved and stored elsewhere over-night. ○ Light Trucks are a single rear axle single rear wheeled vehicle, often seen as an ice cream truck or similar unit. ○ Medium Trucks are dual rear axle rear wheeled vehicles, usually limited to under sixteen feet, which make up the largest portion of the food truck community. ○ Heavy Trucks are multi-axle vehicles generally over sixteen feet and can include truck tractors and other configurations serving large gatherings.
