  11. BZA#2019-02 Variance Requests & Responses The Board of Zoning Appeals is to review questions (a,b,c,d) and use them to determine the findings of fact to make their decision. VARIANCE REQUEST: The request includes a variance from the 25’ required setback from the rear property line. a. There are extraordinary and exceptional conditions pertaining to the particular piece of property as follows: Applicant’s response: New room addition already extends past the 25’ setback. We intended for the screen porch to be built covering the remaining section of previous deck, at the time of room addition in 2015. Due to insufficient funds to complete the screen porch at that time, we assumed we would be able to add the screen porch in designated section at a later date. We have invested a large sum of money in improvements, and would prefer to stay put with the screen porch if possible.

Because of these conditions, the application of the ordinance to the particular piece of property would effectively prohibit or unreasonably restrict the utilization of the property as follows: Applicant’s response: Not applicable

  13. BZA#2019-02 Variance Requests & Responses Continued d. The authorization of the variance will not be of substantial detriment to adjacent property or to the public good, and the character of the district will not be harmed by the granting of the variance for the following reasons: Applicant’s response: Every house on my street has a patio, deck, screen porch, or sunroom addition on the back of their home that extends past the 25’ setback, either approved by the permit office or not approved (no permit obtained). Our requested screen porch will the same as other legal, non-conforming structures at other homes on street, and will be similar in likeness and design. Sec. 30-293 (c, 2, d) Board of Zoning Appeals The board may not grant a variance, the effect of which would be to allow the establishment of a use not otherwise permitted in a zoning district, to extend physically a nonconforming use of land or to change the zoning district boundaries shown on the official zoning map. The fact that property may be utilized more profitably, if a variance is granted, may not be considered grounds for a variance.
