GREAT TOOL …IF IMPLEMENTED EFFECTIVELY

Chapter 15 of EVFTA is a good tool to advance the conservation and sustainable management of natural resources including addressing illegal trade in wildlife "(d) Adopt and implement appropriate effective measures, which are consistent with its commitments under international treaties to which it is a Party, leading to a reduction of illegal trade in wildlife, such as awareness raising campaigns, monitoring and enforcement measures."

MAJOR OBSTACLES

Prime Minister’s Directive No. 28/CT-TTg: adopt a series

  • f measures

against wildlife trafficking

Enforcement work: progressing but not supported by effective prosecutions and punishment upon convictions that would deter further criminal activity.

  • Corruption: tax trade
  • “Wildlife crime is not a serious form
  • f crime“ perception
  • Psychological obstacle: not just act

as “traffic police”

The new Criminal Code will permit law enforcement to impose criminal penalties for offenses that were previously considered lesser crimes.

How we can pursue a woman selling a trophy marine turtles, if a kingpin can kill thousands and never be held accountable?

LEGISLATION OBSTACLE

Crocodile farming, a success story? Contradictory government policies have sought to encourage farming and the commercial trade of wildlife while trying to protect those very same species in nature.

ALLOWING CRIMINAL TO KEEP TIGERS FOR “CONSERVATION PURPOSES”?!

 Earlier 2016: Pham Van

Tuan’s wife and legal representative of Bach Ngoc Lam Co. Ltd) permitted to keep 15 tigers for “conservation purposes”

 Mid 2016: Vietnam CITES

Management Authority issued permits to the Bach Ngoc Lam Co., Ltd. to import nine tigers from Europe.

We ask EU states don’t send tigers to privates farms in Vietnam Tuan is twice-convicted tiger trafficker with known ties to organized criminal networks

CSR PARTNERSHIP

CSR AT A GLANCE

  • Public Awareness: No longer a brand-new

concept though still limited CSR awareness amongst enterprises and society

  • Economic challenge: Lack of financial

resources and techniques to ensure CSR (especially with SMEs)

  • Legal framework: No incentive frameworks

for good CSR practice

On August 28th 2015, cosmetics joined medicinal and supplemental food products on the list of health products in which endangered species products are banned from use as an ingredient.

OPPORTUNITIES AND EXPECTATIONS

 2016: Revising Law on Forestry and Management: the

“foundation” law provides the basis for nearly all decrees and regulations in relation to wildlife and habitat protection.

 2017: New Criminal Code comes into effect  EVFTA:

  • focus on enforcement of national wildlife laws
  • focus on enforcement and implementation of

multilateral environmental agreements (MEAs) like the

  • CITES. (tiger farming, etc)
  • establish cooperative programs in combating wildlife

crime

  • promote CSR practices and civil societies involvement
