Definitions

Zoning District: A section of the city in which zoning regulations and standards are uniform. (APA) Permitted Use: A use permitted in a district without the need for special administrative review and approval, upon satisfaction of the standards and requirements of the governing ordinance. (APA) Conditional Use: A use that, because of special requirements or traits, may be allowed in a particular zoning district only after review by the commission and granting of conditional use approval imposing such conditions as necessary to make the use compatible with other uses permitted in the same zone or vicinity. (APA) Special Land Use Permit: A specific approval for a use that has been determined to be more intense or to have a potentially greater impact than a permitted or conditional use within the same zoning district. Conditional Approval: An affirmative action by a commissioner or council (Assembly) indicating that approval will be contingent upon satisfaction of certain specified stipulations. (APA) Assembly: The legislative branch of the Municipality of Anchorage, charged with setting policy for the

Conditional Use Process

Pre-Application Meeting

  • Prior to submitting

application.

  • Before or after the

community meeting is held.

Community Meeting

  • First choice shall be the

community council of the project area. If another venue used, an explanation shall be provided for review by the deciding board or commission.

  • 21-day notice, prior to

meeting, required to be sent by applicant to all residents (owners and renters) within 500 feet of project site or the 50 nearest residents (whichever is greater.)

Application Submittal

  • Application completeness

completed.

  • Submittal deadline tied to

established calendar of meetings/public hearing dates (typically 60 days from submittal.)

Agency and Department Review

  • Case number issued and

application uploaded for public review and comment.

  • Distributed to applicable

reviewing agencies, departments, and community council for comment.

Example Use-Specific Standards

Use –specific standards for adult care facilities with three through eight persons: a) These facilities are intended to be minor commercial activities, shall not detract from the principal use allowed in the district, and shall not place an undue burden on any private or public infrastructure greater than anticipated from a permitted development. b) In all residential districts these facilities shall be located only in single family detached structure, excluding detached condominium units. These facilities shall be prohibited if the

  • nly direct access is from a private street.

Example Conditions of Approval

a) Hours of operation are restricted to Monday through Friday, 8am to 5pm. b) An annual report providing a log of any complaints and how they were resolved and the amount of fill removed from the site shall be provided to the Planning Department by December 31 of each year of operation. c) The contact name and phone number for the operation manager shall be publicly displayed at the main and provided in a letter to the Community Council. The operator is required to keep this information current and to update the Community Council of any changes.
