The S ustainable Groundwater Management Act (S GMA)

 S

ustainable Groundwater Management Act (S GMA) was passed by the California legislature in 2014

 Created a framework for sustainable groundwater

management in California

 Sustainable Groundwater Management =

“ Management and use of groundwat er in a manner t hat can be maint ained during t he planning and implement at ion horizon wit hout causing undesirable result s.”

“ … groundwat er management in California is best accomplished locally.” – Governor Jerry Brown, S ept ember 2014

S GMA

 Requires the formation of Groundwater

S ustainability Agencies (GS As) – generally agencies

  • verlying the groundwater basin

 GS

As are responsible for preparing Groundwater S ustainability Plans (GS Ps) and be submitted by:

 January 2020 for critically over drafted basins  January 2022 for remaining high and medium

priority basins

 Creates a single sustainability goal for the basin or

subbasin

 Achieved within 20 years of GS

P implementation

 Maintained without causing undesirable results

Basin Prioritization

 Four groundwater basin categories:

High, medium, low, and very low

 Based on components in California

Water Code S ection 10933(b)

 Population overlying basin or

subbasin

 Number of wells that draw from the

basin

 Irrigated acreage overlying the basin  Reliance on groundwater for primary

source of water

 Allows for intervention by the S

tate Water Resources Control Board (S WRCB) at points throughout the process of achieving sustainable groundwater management

implementation of sustainable groundwater management by GS As

Powers and Authority of a GS A

Adopt rules, regulations, ordinances and resolutions to achieve groundwater sustainability

Conduct investigations for the purpose of:

 Determining the need for groundwater management  Preparing and adopting a GS

P and implementing rules and regulations

 Proposing and updating fees  Monitor compliance and enforcement  Inspection of property or facilities to ascertain compliance

Require registration of a groundwater extraction facility

Require measurement and recording of groundwater extraction (costs borne by owner or operator)

Require groundwater extraction facilities to file an annual report

Acquire land, water rights, rights-of-way, structures, or

  • ther property

Appropriate and acquire surface or groundwater (or rights thereof)

Transport, reclaim, purify, desalinate or treat wastewater or polluted water

Additional authorities

 Regulate or limit groundwater extractions  Limit construction of new wells, or reactivation of older

wells

 Authorize transfers and carryover of groundwater

extraction allocations
