CFTA Exceptions on Single Source Requirements
- Most other requirements are not a lot different than our normal practices with a few
exceptions on single source requirements in bid documents.
- Previously, a proprietary item could be included in specifications for a larger project by
requesting single source approval prior to issuance of the document. Under CFTA rules, if the proprietary item is part of a larger project, CFTA requires inclusion of an “or approved equal” statement.
- Only EPC can approve the removal of that statement with warnings that they will be in
violation of a trade agreement by approving such item.

THE CANADA-EUROPEAN UNION COMPREHENSIVE ECONOMIC AND TRADE AGREEMENT
CETA
- Important: If the estimate for the entire Goods or Services
contract, including all Phases and/or extensions, could exceed $340K, the Tender/RFP requires the new time period. (same rule applies to Construction >$8.5 million)

- Until further notice, the City’s Materials Management website is
the only place that we will post the City’s documents (no change).

NEW WEST PARTNERSHIP TRADE AGREEMENT (effective Jan 1, 2019)
British Columbia, Alberta, Saskatchewan and Manitoba have committed to this Agreement:
- Single Source rules will change
- Consultant procedures will change

Most will not notice the effects of the various trade agreements on everyday tenders/rfps with the exception of:
- Dollar thresholds for tendering Consultants starting in 2019,
maybe sooner.
- Time periods for advertising on website where the tender/RFP
exceeds the dollar limits of CETA.
- an enforceable dispute resolution mechanism…
