The Gas Safe (installation and Use) Regulation 1998

  • The Regulations cover gas systems and appliances in houses, flats, shops, offices,
  • ther commercial and public premises, and holiday accommodation, eg chalets and

certain caravans, mobile homes and boats on inland waterways

  • Mobile food stalls (whether towed as ‘caravans’ or self-propelled) which are made

available to the public in the course of a business are covered. This includes such facilities where the public have access inside the vehicle or caravan concerned as well as ‘serve- through-the-hatch’ vendors. Other types of mobile food stalls (such as marquees, tents, gazebos and portable kitchens) are also covered by the Regulations.

Summary of regulation 3

  • This section of the GSIUR requires anyone carrying out gas work to be competent.

Even if working at premises to which GSIUR does not apply (eg factories, quarries etc), people carrying out gas must be competent to work safely.

  • Employers of people carrying out gas work and self-employed people carrying out gas

work must be a member of a class of persons approved by HSE.

  • This regulation requires any employer or self-employed person requiring work to be

done on a gas fitting to take steps to ensure the person doing the work is registered with a class of persons approved by HSE.

Summary of regulation 8

  • This regulation prohibits any person from carrying out any alteration to premises in

which a gas fitting or storage vessel is already installed which could compromise gas safety.

  • The regulation also prohibits any work on a gas fitting or associated flue/ventilation

system which would result in danger to any person.

  • This regulation imposes a duty on the responsible person for any premises (for

instance, the occupier or owner (eg landlord) of the premises) not to use or permit the use of any unsafe appliance. People carrying out specified work (eg on service pipes

  • r gas fittings) must report any appliance they suspect is dangerous to the responsible

person for the premises, or where this person is not available, to the gas supplier or transporter, as appropriate.

Summary of regulation 35

This regulation requires an employer or self-employed person to ensure that any gas appliance, flue or installation pipework installed at a place of work they control is maintained in a safe condition.

Regulation 35: Duties of employers and self- employed persons

Effective maintenance of appliances usually involves an ongoing programme of regular/periodic inspections, together with any necessary remedial work. In the absence of specific manufacturers’ instructions, effective maintenance should include as a minimum: a) examination of the physical condition and safe functioning of appliance(s), installation pipework, ventilation and any flue for deterioration b) carrying out performance tests c) and taking the necessary remedial action

  • Where premises such as public houses or offices are leased as workplaces, employers’

duties under regulation 35 may interface with landlords’ responsibilities under section 4 Health and Safety at Work etc Act 1974, eg for maintenance of gas heating appliances.

Summary of regulation 36 There are two main duties on landlords: annual safety checks on gas appliances and flues (and that a record is kept and issued, or in certain cases, displayed to tenants) and ongoing maintenance. Although related, these duties are separate and distinct.

  • Provides guidance to those using

propane in cylinders in industrial and commercial premises, LPG suppliers and Authorities.

Scope

  • This Code covers the installation and safe use of propane in cylinders at commercial and

industrial premises.

  • It relates to propane cylinders located out of doors supplying appliances via a fixed

pipework installation, and also propane cylinders used indoors and connected directly to equipment.

Section 3 Legal and contractual obligations

  • Contractual responsibilities
  • Where cylinders are supplied from a retail premises, dealers, stockists
  • etc. the point of supply should make available basic safety information.
  • Where the cylinders are supplied under a term of contract, the LPG

supplier must ensure that the consumer has been provided with full instructions which should include the following as appropriate:

  • Properties and characteristics of LPG
  • Normal operating procedures
  • Contact arrangements for a gas supply
  • Arrangements for maintenance
  • Action in the loss of gas pressure
  • Action in the event of emergency

  • Generally, cylinders should be located:
  • in the open air outside buildings, situated on firm level ground in a well-ventilated location.
  • located against a wall or structure of the building.
  • Consideration should be given to positions which are adjacent to walls or structures with a

fire resistance of not less than 30 minutes.

  • Where they remain readily accessible at all times.
  • Where they do not obstruct any means of access to or from the premises.
  • Where they are reasonably protected from accidental damage.
  • Where necessary suitable protection should be provided against possible damage or

6 - Use of LPG cylinders inside premises

  • If it is not reasonably practicable to provide a piped system, the total quantity of LPG used

in the premises should not exceed 100 kg unless a full and documented risk assessment has been carried out.

  • Appliances should be sited away from escape routes and combustible material.
  • Adequate provision for the ventilation of the room should be made when the appliances

and cylinders are used.

  • Cylinders should not supply gas to more than one appliance.
  • Cylinders should be positioned in the upright position on a firm and level hard standing.

6 - Use of LPG cylinders inside premises

  • Cylinders which are liable to be knocked over should be secured or provided with

barriers.

  • Where reasonably practicable, cylinders should be protected from unauthorised

interference.

  • The storage of rubbish, cardboard or other flammable material should not be permitted

adjacent to LPG cylinders.

  • Where necessary, a physical barrier protecting the space around the cylinders should be

considered.

  • Associated equipment e.g. manifolds, pressure regulators etc. should be located as close

as practicable to the cylinder(s).

Key things to take away

  • Always use a Gas Safe registered engineer to fix, fit or

safety check / service your gas appliance

  • Always ask to see the ID card of anyone carrying out gas

work – and check the information on the back

  • Get your appliances regularly serviced and safety checked

every year

  • The poisonous gas carbon monoxide cannot be seen,

tasted or smelt. Fit a carbon monoxide alarm to alert you if there is CO in your home.
