Legislative Regulation

  • f Public Procurement

Since January 1, 2013, the Law of the Republic of Belarus “On State Procurement of Goods (Work, Services)” regulates the procedure for conducting public procurement of goods (works, services) in the territory of the Republic of Belarus. During the preparation of the law, the provisions of the UNCITRAL Model Law

  • n public procurement have been taken into account.

The national legislation on public procurement was harmonised with the provisions of the procurement procedure Regulation Protocol to the Eurasian Economic Union Treaty. The authorized state body for state procurement is the Ministry of Antimonopoly Regulation and Trade of the Republic of Belarus.

Results of Legislative Reform in Public Procurement in 2015

 Conversion of all public procurement tender procedures into electronic

procedures after awarding the contract.

 The official website contains information about all contracts concluded,

additional agreements to them, as well as the results of their execution.

Public Procurement Market

Annually, the state bodies and budget organizations spend about $ 8 bln on the purchase of goods (works, services) for implementation of public authorities and socially significant

  • functions. It is about 10 percent of the country's gross domestic

product. At the same time, the majority of violations in the sphere of public procurement do not belong to corruption, they are administrative

  • ffenses.

Reforming of the Public Procurement System In the short term, the process of public procurement will become more transparent, which will minimize corruption risks. The new version of the Law “On State Procurement of Goods (Work, Services)” is being adopted by the Parliament. The Law provides for introduction of a state automated information system to manage public procurements. A new information resource will be created to accumulate all the information on public procurement in order to minimize the interference of the parties and guarantee the invariability of the conditions stated in the transactions.

Reforming of the Public Procurement System Tasks:

 Production, processing, storage and provision of data on public

procurement procedures.

 Automated monitoring of public procurement procedures from the

time of posting of the annual procurement plan to the execution of the contract.
