people with disabilities v Public spending can account for 15% to 20% of a country’s GDP v No policy is cheaper than giving jobs to people with disabilities v No job policy is cheaper than public procurement v It demonstrates Government sensibility v More effective public expenditure v It stimulates social awareness markets

v The Administration can launch preliminary market consultations and request the collaboration of businesses in order to better prepare a tender v Open simplified procedure that will not require provisional guarantee v Involving the presentation of offers, the use of the European Single Procurement Document will be mandatory for several procedures v Flexible solvency requirements will be introduced

v Elimination of the procedures negotiated without publicity, motivated by their lack of transparency v Creation of an innovation partnership procedure aimed at developing new innovative products, services or works v The Administration will also monitor that subcontractor do not default on payments, making it necessary to register subcontractor invoices in an electronic register v Introduce best price-quality criteria (not only economic values)

v The purpose of the Law already contemplates that it has to facilitate access to public procurement for Social Economy Entities or Social companies v Social and environmental criteria must be incorporated transversally in all contracts v Possibility of reserving some contracts for social, cultural and health services to Social Economy companies and entities v Mandatory reservation of contracts for Insertion Companies and Inclusive Enterprises according to their definition and requirements under the new law v It is expressly contemplated that social agreements by social entities shall be excluded from the strict requirements of the contract law

• 3. How the system could be improved to maximize the goals

v Give higher score to companies that work with groups at risk of exclusion v Force subcontraction of a part of the service to social enterprises v Create a public-private authority to control social clauses
