  2. 21F of Local Government Act 2000 - Overview and scrutiny committees: flood risk management (1) This section applies to a local authority which is a lead local flood authority for an area in England. (2) The arrangements required under section 21(2) include: Page 2 • arrangements to review and scrutinise the exercise by risk • management authorities of flood risk management functions or • coastal erosion risk management functions which may affect the • local authority’s area.

  3. Lincolnshire has a unique Joint Scrutiny Committee reflecting the Flood Risk and Water Management Partnership Page 3

  4. Committee’s Broad Terms of Reference • The development and delivery of the Local Flood Risk Management Strategy • The effectiveness of the Lincolnshire Flood Risk and Drainage Management Partnership Page 4 • Lincolnshire County Council's delivery of its local leadership role in relation to flood and water management . • The work of all flood risk management authorities operating within Lincolnshire

  5. Committee’s Broad Terms of Reference (cont.) • The local implementation of the Environment Agency-led National Strategy for Flood Risk and Coastal Erosion. • All major strategic initiatives relating to water management. Page 5 • The GLLEP Water Management Board, including the development and implementation of its Water Management Plan.

  6. Unlike as with Highways, we are not autonomous - we are the “Lead Local Flood Authority” and our partners are: • Lincolnshire County Council - LLFA • The Environment Agency Page 6 • 14 Internal Drainage Boards • 7 District Councils • 2 Water Companies • Regional Flood & Coastal Committee • Emergency Planning & Response

  7. Lincolnshire has a wide range of potential flood risk Page 7

  9. So who does what? Page 9

  10. The Environment Agency • Coastal Defence • Main rivers Page 10 • National overview of flood risk management • Floodline – flood warning system

  11. Internal Drainage Boards (IDBs) • Drain low-lying areas (40% of Lincolnshire) • Land drainage – Page 11 especially agricultural land, but also some urban areas • Water level management

  12. Water Companies • Supply water • Remove and treat foul water (foul and combined sewers & treatment works) • Surface water drainage of developed areas (surface Page 12 water & combined sewers)

  13. District Councils • Anomalous S14 works (only) on ordinary watercourses (outside IDB areas) – LCC has all other Land Page 13 Drainage Act responsibilities • Local Planning Authorities

  14. LCC as the Highway Authority… Page 14

  15. ...and now also the Lead Local Flood Authority, with new duties to manage local flood risk Page 15 Local flood risk is: Surface water Groundwater Ordinary watercourses

  16. LLFA responsibilities include… • Preliminary Flood Risk Assessment (PFRA) • Local Flood Risk Management Strategy • Duty to investigate flooding • Flood risk management works – minor works and Page 16 capital programme through FDGiA • Asset Register • Land Drainage Act powers (delegated to IDBs) • Emergency response • SuDS and statutory consultee role, as part of the development management process

  17. Joint Flood Risk and Drainage Management Strategy • All sources: coastal, fluvial, surface water • Common vision • Links flood risk, drainage & Page 17 emergency planning • Environmental benefits & Water Framework Directive

  18. Duty to investigate flooding from any source - Section 19 of the Flood and Water Management Act 2010: Surface water flooding - summer 2012 Page 18

  27. Community Risk Register - 4 of the top 9 ‘enduring’ risks….are flood related • Pandemic flu • Coastal flooding • Inland flooding • Louth ‘rapid catchment’ • Severe weather • Fuel shortages Page 27 • Loss of critical infrastructure • Animal disease • Oil pollution • Industrial & transport

  28. WHAT WE CONSIDER AS A CONSULTEE IN THE PLANNING PROCESS - AS LLFA • Local sources of flooding (EA previously had this role) • Flood risk to / from (incl. minor development) Page 28 • Safety • Secondary consultations • SuDS for majors (10+)

  29. LCC provides an integrated service Flood Risk & Highways and a “single point of contact” approach for Development Management Highways Flood risk & drainage Integrated response Less detail Pre planning enquiries Pre planning Page 29 enquiries Outline applications Outline applications Full applications Full SUDS adoption & maintenance secured through planning - applications implemented by LLFA with respect to Highways More detail

  30. Statutory Consultees in the Planning Process NB – we are not the decision making authority! Examples: • Adjoining landowners • Canal & River Trust Local EA • County Planning Highway Planning Authorities Authority and Page 30 • EA IDB Authority - Lead Local • H & S Flood Decision • Highways England Authority W&SC • Natural England Maker • Parish Councils • Rail Network Operators • Water & sewerage Member - notification undertakers

  31. We Consider Surface Water Flooding Page 31

  32. We Consider SuDS on Major Developments (10+ properties) Page 32
