What is a leave of absence?

A leave of absence is needed when an employee is absent from work for an extended

  • period. 4J defines an extended period as more than five (5) work days.
  • If an employee is absent from work for five (5) or less work days, a leave of

absence is not always needed. Some exceptions, such as bereavement leave, FFCRA leave, and unpaid leave apply. Contact Human Resources for more information. A leave of absence is needed when an employee is absent due to one or more of the following reasons:

  • The birth of a child or placement of a child for adoption or foster care;
  • To bond with a child (leave must be taken within one year of the child’s birth or placement);
  • To care for the employee’s family member who has a qualifying serious health condition;
  • For the employee’s own qualifying serious health condition that makes the employee unable to perform the

employee’s job;

  • For qualifying exigencies related to the foreign deployment of a military member who is the employee’s

spouse, child, or parent.

  • For the loss of a family member.

Why is a leave of absence needed?

Families First Coronavirus Response Act (FFCRA)

  • On March 18, 2020 the federal government passed

the Families First Coronavirus Response Act (FFCRA) which broadened the reasons for a protected leave of absence.

  • Part of the FFCRA awarded additional paid sick

leave to eligible employees who need to be absent from work for reasons related to COVID‐19.

  • The FFCRA expires on December 31, 2020.

Oregon Family Leave Act (OFLA) Expansion

  • The State of Oregon also broadened the Oregon

Family Leave Act (OFLA) to include the need to care for an employee’s child whose school or place

  • f care has been closed in conjunction with a

statewide public health emergency declared by a public health official as an applicable reason for OFLA leave.

FFCRA Qualifying Reasons for Leave

Under the FFCRA an employee may need a leave of absence due to one or more of the following reasons:

  • Subject to a Federal, State, or local quarantine or isolation order

related to COVID‐19;

  • Has been advised by a health care provider to self‐quarantine related

to COVID‐19;

  • Experiencing COVID‐19 symptoms and is seeking a medical diagnosis;
  • Caring for an individual who has either been subject to a quarantine or

isolation order as described above, or who has been advised by a health care provider to self‐quarantine;

  • Caring for their child whose school or place of care is closed (or child

care provider is unavailable) due to COVID‐19 related reasons; or

  • Experiencing any other substantially‐similar condition specified by the

U.S. Department of Health and Human Services.

FFCRA Paid Leave

The FFCRA awards up to two weeks (80 hours, or a part‐time employee’s two‐week equivalent) of paid sick leave paid at 100% for the qualifying reasons listed below (up to $511 daily and $5,110 total):

1.

Subject to a Federal, State, or local quarantine or isolation order related to COVID‐19;

2.

Has been advised by a health care provider to self‐quarantine related to COVID‐19; or

3.

Experiencing COVID‐19 symptoms and is seeking a medical diagnosis. The FFCRA awards up to two weeks (80 hours, or a part‐time employee’s two‐week equivalent) of paid sick leave paid at 2/3 for the qualifying reasons listed below (up to $200 daily and $2,000 total):

  • Caring for an individual subject to an order described in (1) or self‐quarantine as described in (2); or
  • Experiencing any other substantially‐similar condition specified by the U.S. Department of Health and

Human Services. The FFCRA awards up to 12 weeks of paid sick leave and expanded family and medical leave paid at 2/3 for the qualifying reason listed below (up to $200 daily and $12,000 total):

  • Caring for their child whose school or place of care is closed (or child care provider is unavailable) due

to COVID‐19 related reasons.
